The petitioner being an Editor of Local newspaper "Lokvishwas" published from Partur, is aggrieved by the decision of the Municipal Council in re-allotting the premises allotted to him, in favour of respondent No.6. The allegation levelled in the petition is that respondent No.6 manipulated the respondents Municipal Authorities for allotment of the plot in question in his favour and despite a strong objection being raised by the petitioner, the plot was allotted to him. 2.

While admitting the writ petition on 08/02/2001, this Court has passed the following order :- khs/Jan.2022/

- 2 - "Respondent No.6 shall not create third party interest on the subject plot, until further order."

The allotment in favour of respondent No.6 is therefore continued till date.

The learned counsel for the petitioner states that when he attempted to contact the petitioner, on being intimated that the petition is listed for final hearing, he is informed that the petitioner is no more alive to prosecute the petition. In the wake of the above, due to efflux of time, the rights being crystalized in favour of respondent No.6 on allotment of the said piece of land in the year 1990, the petition has been rendered infructuous and is disposed off as such.
