Learned advocate for appellants produced the intimation letter dated 02/09/2004, addressed to him by the appellant, instructing him to withdraw the appeal. Unfortunately, for about 19 years, nothing has been happened and the appeal was kept pending.

When the matter was called out in the morning session, the Court insisted learned advocate for appellants to take instructions. He contacted the appellants and came with instruction that the appellants do not want to proceed with the appeal. 3.

Letter dated 02/09/2004 is taken on record and marked as Annexure 'A'. Since appellants do not want to proceed with the appeal, the appeal stands disposed of.

Record and proceedings be returned back to the Trial Court.
