Learned advocate for appellant seeks permission to withdraw the appeal as the interim protection under section 438 Cr.P.C., granted by Sessions Court is questioned in the present appeal. He submits that after filing of present appeal, learned Sessions Judge, has confirmed the interim protection. He therefore, seeks permission to withdraw the appeal with liberty to challenge the final order passed by Sessions Court. 2.
