The challenge in this application is to the order rejecting the application for transfer of sessions case from one Additional Sessions Judge to the other one. The present application has been filed by the victim. He has been permitted to assist the prosecution in the case. Had such an application been moved by the Special Public Prosecutor, who has been appointed to conduct the matter, the points urged therein could have been considered. Since no such application was moved by the learned Special Public Prosecutor before the learned Sessions Judge, this Court finds no merit in the application.
