The learned counsel submits that in view of the office objection that in terms of prayer clause "C" Second Appeal is maintainable against the impugned order, the learned counsel appearing for the petitioners seeks leave to withdraw the present petition. 2.

In view of the objection raised by the Registry, liberty is granted to file a Second Appeal.

The learned counsel for the petitioners submits that the time spent in prosecuting the present petition may be excluded in computing the period of limitation.

4.

Liberty to move an appropriate application in the second appeal, when the same is filed.

5.

The Writ Petition is dismissed as withdrawn with liberty as above.
