I do not find any substance in this writ petition for the reason that, the petitioner has not stated in his appeal before the Commissioner, Nashik Division, Nashik that the appeal is within limitation from the date of knowledge and that the order impugned before the Commissioner was communicated to the petitioner, belatedly. Apart from this, this Court and even the Supreme Court taken consistent view that the Commissioner while entertaining said appeal is not the the Court and as such has no powers to condone the delay. 2.

In view of the above, I do not find any substance in this writ petition. Writ Petition is thus dismissed. No costs. ( V.K. JADHAV, J. ) ...
