It transpires from record that second appeal was rejected vide order dated 22.06.2016 and it was registered as Rejected Case No. 586 of 2016. Thereafter it was restored vide order dated 02nd December, 2016 passed in Civil Application No. 15321 of 2016.

By order dated 03rd December, 2024, notices were issued to the respondents. Respondent Nos. 2 and 3 were reported to be dead as per the bailiff report.

On various times matter was listed before the Court for taking steps against deceased respondents. No steps were taken. This Court passed order on 30.06.2025 granting time upto

2 38 sa 247.17 11.08.2025. Despite that steps have not been taken. Today none appears for the appellant.

Second appeal stands dismissed for default. No application for restoration shall be entertained unless an amount of Rs. 10,000/- (Rs. Ten thousands only) is deposited in this Court. 5.

In view of dismissal of second appeal, nothing survives in the civil application. The civil application also stands disposed of.
