Learned A.G.P. accepts notice for Respondent Nos.1 to 4. 3.

Mr.Tripathi, learned counsel submits that the petitioner had filed an application with the SDO and the acquiring body for payment of rental compensation. The possession has been taken prior to the issuance of notice U/s 4 of the Land Acquisition Act, however, the same is not yet decided.

Learned A.G.P. states that in case the same is pending, the authority will decide it on its own merits.

The petitioner may file an application for payment of rental compensation with the appropriate authority. In case such an

application is filed, the appropriate authority shall decide the said application on its own merits in accordance with law after hearing all parties concerned, expeditiously, preferably within nine (9) months from the receipt of the application.

The Writ Petition is disposed of. No costs.
