Mr. Aghav, the learned counsel for the petitioner submits that the respondents have not decided the representation given by the petitioner Exh.D-2. The respondents be directed to decide the same. Mr.Wagh, the learned counsel for the respondents submit that the said application is not given within time i.e. within three months, as such, same cannot be considered.

The application for compassionate appointment is to be filed within one year. The same appears to have been filed within one year. In the light of that, we pass following order:

The respondents shall decide the representation given by the petitioner for appointment on compassionate ground (Exhibit D-2) on its own merits, in accordance with law, expeditiously preferably within four months.

All contentions of the respective parties are kept open. 5.

Writ petition disposed of. No costs.
