Learned counsel for the petitioner/original defendant no.1, on instructions, submits that during pendency of this Writ Petition, the suit bearing Regular Civil Suit No. 57 of 1996 came to be transferred to the court at Loha from Kandhar and it was renumbered as Regular Civil Suit No. 36 of 1999. The trial court, by judgment and decree dated 17.08.2006, has dismissed the suit. The appeal bearing Regular Civil Appeal No. 48 of 2006 came to be preferred and it was also dismissed in default. Learned counsel for the respondents has also not disputed the same. 2.

In view of the above, this Writ Petition has become infructuous. This Writ Petition has been preferred against the order

907-WP-2180-2005 -2passed by the trial court allowing to pay deficit court fees alongwith the impounded documents. The Writ Petition is accordingly disposed off. Rule discharged.
