Heard learned counsels for the parties. Application is filed for recalling of order of dismissal for non prosecution, passed by this Court in Family Court Appeal No. 11 of 2006. Learned counsel for the appellant is taking blame on himself.

In view of the contentions and submissions made, this Court holds that the civil application is allowed. Order of dismissal dated 4-12-2017 is recalled. Family Court Appeal No. 11 of 2006 is restored and to be placed on regular board after circulation for final hearing. 3.

The appointed counsel need not appear in the matter, though he was appointed earlier in the matter.
