Mr. Sonwalkar, learned counsel for the respondent No.2 opposes the application. However, considering the averments made in the present application and the fact that the dismissal was on account of the fact that the Advocate for the petitioner could not contact the petitioner to get the instructions as sought by the Court, the Civil Application is allowed in terms of prayer clause (A).
