Learned Counsel for the Petitioners, on instructions, makes a statement that without prejudice to the rights and contention of the Petitioners he wishes not to press application Exh. 60 filed in RCS No. 296/2022. He however seeks leave to prefer any appropriate application with regard to the proof of the video recording, at appropriate stage before trial Court.

Learned Counsel for Respondents submit supports the impugned order.

Having perused application Exh. 60 this Court is of the view that the said application was pre-

21-WP-1793-2024.odt mature. Since Petitioner now wishes to withdraw application Exh. 60, with liberty to move appropriate application at relevant stage, in respect of video recording, this Court does not find any reason to go into merit of impugned order.

In view of the above, application Exh. 60 filed in RCS No. 296/2022 is allowed to be withdrawn. Consequently, impugned order becomes non est. As a result of this, Petition is disposed of as withdrawn with liberty as prayed for.
