The Education Officer, by impugned communication has turned down the proposal invoking his powers under clause 26.4 for correction of the petitioner's school record only on the ground of he having left the school, which ground is not per se sustainable in the light of full bench decision in the matter of Janabai D/o. Himmatrao Thakur Vs. State of Maharashtra and others; 2019 (6) Mh.L.J. 769. 2.

The writ petition is disposed of by directing the respondent no. 2 - Education Officer (Primary) to consider the proposal afresh on its own merits but it shall not be rejected only on the ground of petitioner having left the school and shall consider the decision in the matter of Janabai (supra).
