The sole appellant has died on 02.09.2019. The learned advocate for the appellant had moved Civil Application (Stamp) No.37226/2019 to bring on record legal heirs of the deceased sole appellant. However, the office had raised objections. The learned advocate has failed to remove the office objections. As a result, the registration of the said Civil Application came to be refused vide order dated 22.09.2021.

Consequently, as the sole appellant has died on 02.09.2019 and his legal heirs are not brought on record within stipulated period, the second appeal abates entirely. In turn, following order.

ORDER
