IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.2641 OF 2017 (Vijay Bhaskar Joshi Vs. Deepali Vijay Joshi) Mr.S.R.Andhale, Advocate for the petitioner.

Mr.Shaikh M.A.Jahagirdar, Advocate for the respondent. ( CORAM : Ravindra V.Ghuge, J.) DATE : 13/09/2017 PER COURT :

1.

The petitioner/husband is aggrieved by the grant of Rs.3,000/- as interim maintenance to the respondent/wife by order dated 21/07/2016. Prima facie, I find that the quantum of interim maintenance can not be said to be exorbitant as the respondent/wife is expected to survive on Rs.3,000/- in a month. 2.

Learned Advocate for the petitioner submits that pursuant to the order of the Educational Society dated 28/03/2016, the petitioner has lost his employment as a Junior College Teacher in English on clock hour basis with the Janata Vidya Mandir. 3.

On 03/03/2017, this Court recorded the statement of the petitioner that he is willing to co-habit with the respondent. Learned Advocate for the petitioner once again reiterates his request that the khs/SEPT. 2017/2641-d

petitioner is willing to save his marriage and restore the marital relations with the respondent.

4.

Considering the above, this petition is disposed of. If the petitioner makes an application to the Trial Court stating that he desires to restore his marital relations and save his marriage, the Trial Court may consider the said application on its own merits and preferably within a period of 2 months. The Trial Court may also consider referring the matter to the Mediation Center in the light of the said application.
