The plaintif has instituted the suit seeking damages of Rs.5,00,000/- from the respondents-defendants alleging that due to the use of generator, the premises of the plaintif which were let out to the defendants, is damaged.

In the suit, the plaintif moved an application for appointment of Court Commissioner. All that is said in the application that an enquiry is required to be conducted to ascertain the factual position.

The application is unintelligible and nothing is disclosed as to why appointment of Court Commissioner is necessary and what is expected of the Commissioner.

The Trial Court has rightly rejected the application for appointment of Court Commissioner. The petition is dismissed.
