Heard the learned counsel for the applicant and the learned A.P.P. for the respondent-State.

The applicant was arrested in another crime and thereafter he was transferred in this crime. Nothing has been recovered from him. The learned counsel for the applicant would submit that only on the suspicion and being an accused in another crime, the applicant has been arraigned as an accused. There appears substance in the argument of the learned counsel for the applicant. 3.
Learned A.P.P. opposed the application contending that the investigation is in progress, therefore, the applicant may not be

The facts of the case reveal that the applicant was not arrested directly in this crime. He was arrested in another crime and then transferred. That apart, nothing has been recovered from the applicant. Therefore, he deserves bail on certain conditions. Hence, the following order :-
ORDER
i) The application is allowed.
ii) The applicant Sachin Bharat Khillare, be released on bail on furnishing PB and SB of Rs. 50,000/- with one solvent surety of the like amount, in C.R. No. 241/2022 registered with Purna Police Station, District Parbhani for the offence punishable under Section 395 of the Indian Penal Code on the conditions that the applicant shall attend the concerned Police Station on every Monday and Saturday of each month, between 11.00 a.m. to1.00 p.m. till filing charge sheet.
