In view of the office objections, the petitioner has been charged with the court fees, considering the prayer clause (B) by which he is seeking inclusion of apart from him, names of several other persons on the electoral roll.

The learned advocate for the petitioner, on instructions, submits that the petitioner is seeking relief only to his extent and would amend the prayer clause (B) suitably. Leave is granted. Amendment to be carried out forthwith.

We have heard the learned advocate for the petitioner as well as Mr Dighe, learned advocate, who appears for respondent Nos. 2, 3 and 5.

The petitioner has been elected as Sarpanch after the cut off date notified by the State Election authority and is now seeking to participate in the elections of the Agricultural Produce Market Committee from the requisite franchis.

Both the sides are unanimous that the High Court of Bombay (Nagpur Bench) by order dated 05-01-2023 in Writ Petition No. 3613 of 2022 with connected matters, has extended the time for holding the elections till 30-04-2023.
