The land of the petitioner has been acquired for Majalgaon Dam. According to the petitioner the acquired land has not been utilized for that purpose and he therefore asked for return of the land. 3.

According to the learned Counsel for the petitioner the entire land has not been utilized. In the alternative he submits that if it is found that some of the land remained unutilized the same may be directed to returned and if the same is not possible the petitioner may be provided with alternate land.

The respondent/acquiring body has stated on affidavit that the land acquired has been utilized for public purpose. The details thereof have been given in paragraph 4 of the said affidavit in reply. Narwade/

Since the acquired land has already been utilized and the petitioner has been paid compensation, we find the petition lacks merit. The same is therefore dismissed.
