Mr. Choudhari, learned Advocate appearing for respondent submits that by efflux of time and on account of disposal of proceeding i.e., B.I.F.I.R. bearing case No.104 if 2004 decided on 18.01.2008, the challenge raised in this petition has lost sanctity and questions as raised in this petition rendered academic. He, therefore, submits that writ petition has become infructuous and can be disposed of accordingly. 2.
Learned Advocate appearing for respondent urges that this Court may not disturb impugned orders as passed by Executing Court. 3.
Considering submissions advanced, when petitioner is of the view that impugned orders under challenge in this writ petition do not require further deliberation, there is no reason to delve into merits of the matter. Hence, writ petition stands disposed of as infructuous. It is expected that Executing Court would endeavour execution proceeding as expeditiously as possible.
