It transpires that the lawyer appearing for the appellant is unable to take steps seeking discharge in the matter. He was granted time by the last order dated 28.07.2025 of this Court. 2.

It is very surprising that appellant is a local body and it is not responding to the lawyer. Matter is very old one. For want of due procedure I cannot discharge the lawyer appearing for the appellant.

I have no alternative than to dismiss the appeal in default. In case the appellant seeks to restore the second appeal, it is

2 53 sa 209.99 indicated that heavy cost will be imposed. Second appeal is dismissed in default.

In view of dismissal of the second appeal, nothing survives in the Civil Application No. 2287 of 1999. Same also stands disposed of.
