By this petition, the petitioner assails the order dated 09.12.2021 passed below Exhibit 31 by the learned Civil Judge, Senior Division, Sangamner, in Regular Civil Suit No. 421/2014, whereby the application filed by the petitioner for appointment of a Court Commissioner came to be rejected.

Learned Counsel for the petitioner submits that now the evidence of the plaintiff is recorded. In that view of the matter, the trial in the suit has already commenced.

Therefore, the petitioner is at liberty to file a fresh application after the evidence of both parties is over.
