Heard the learned counsel for the applicant and the learned APP for the respondent-State.

It has been alleged against the applicant that he shot the fire at the complainant, but he avoided. However, the cartridge was not discovered from the spot of the incident nor the pistol has been recovered from the applicant. In such circumstances, the antecedents to the discredit of the applicant would not come in the way. The circumstances are strong enough favourable to the applicant for bail. Hence, the following order :

(i) Bail Application is allowed.

1003-BA.42-23.odt (ii) Applicant HARI VITTHAL WALTURE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.522 of 2022, registered by Police Station Gangapur, District Aurangabad, for the offences punishable under 307, 323, 504, 506 read with Section 34 of the IPC and Section 3 read with Section 25 of the Arms Act, on the condition not to tamper with the prosecution witnesses.
