We have heard Mr. Dhorde, learned senior advocate for petitioner, Mr. Sapkal, learned senior advocate for respondent no.1, Mr. Gaikwad, learned

(2) advocate for respondent no.2 and Mr. Hon, learned senior advocate for respondent no.3.

The petitioner is assailing the interlocutory order passed by the Presiding Officer of D.R.T., Aurangabad. Under the interim order the tender process has been stayed.

Though the learned senior advocates sought to canvas submissions on merits, considering the fact that, it is against the interlocutory order, the cause for justice would be subserved by directing the Tribunal to finally decide the proceeding within stipulated period.

The Tribunal has already directed the parties to file their reply on 15.01.2022.

All the parties are appearing in the matter before this Court. The parties shall file their reply and documents on which they seek to rely positively on or before 15.01.2022. The Tribunal shall hear all the parties and pass final order on or before 31.01.2022.

We have passed this order directing D.R.T.

Aurangabad to decide it finally upto 31.01.2022, as there are other aspects such as payment made to the provident fund and other aspects. Considering that, the D.R.T., Aurangabad shall positively decide the proceeding finally by 31.01.2022.

Writ Petition is disposed of. No costs.
