In the first session today, the petitioner had sought deletion of respondent Nos. 3 & 4 which was permitted at the risk of the petitioner. Deletion has been carried out. This matter was kept in the second session today, at the request of the parties since the petitioner Nos. 1, 2 & 3 had arrived at a settlement with respondent No. 1.

Shri Nagargoje, learned Advocate has placed on record the compromise terms dated 02-03-2015 duly signed and sworn by the petitioner No. 2 and 3 and respondent No. 1, identified by their learned Advocates Shri Nagargoje, Shri V.V. Bhavthankar and
3536.1990 WP Shri Saokolkar. Petitioner No. 1 is 90 years old lady who is represented by GPA through petitioner No. 2 . Respondent No. 1 has also verified and sworn the terms of compromise since it is a document jointly filed by petitioner Nos. 2 & 3 and respondent No. 1.

The joint compromise terms are taken on record and marked as 'X' for identification.

Shri Nagargoje, Shri Bhavthankar and Shri Sakolkar, learned Advocates submit that the concerned parties are also present in the Court whom they identify. The learned Advocates further state that deleted respondent Nos. 3 & 4 are unconnected with this compromise. This compromise would not in any way affect their rights. It is, therefore, prayed that the petition be disposed off in terms of compromise 'X'.

Recording the statements made by the learned Advocates, this petition is disposed off in terms of the compromise exhibit 'X'. Rule is accordingly made absolute in terms of the compromise. ( RAVINDRA V. GHUGE, J. ) SDM*March-2015
