Applicant apprehends arrest in connection with Crime No. 926 of 2023 registered with Sangamner City Police Station, District Ahmednagar for offence punishable under sections 327, 354-B, 323, 504, 506 read with section 34 of the Indian Penal Code.

FIR is lodged by Vimal w/o Babasaheb Khandre alleging that on 13.11.2023. at 4.45 hrs., Prashant Bapusaheb Shelke, Manish Bapusaheb Shelke, Pranav @ Michel Bapusaheb Shelke all have assaulted informant. Prashant has outraged her modesty, Manish and Pranav came there abused and threatened informant, Pranav snatched gold chain of 1.5 tola.

Heard learned advocate for applicant and learned APP for respondent - State. Perused the investigation papers. 4.

Father of applicant has filed complaint application to Tahsildar and Sub Divisional Officer that their approach road to the agricultural field is closed by informant. The said complaint is dated 03.07.2023. Thus, a civil dispute appears to be pending between applicant's father and informant. Applicant is a shopkeeper and has no criminal antecedents. Possibility cannot be ruled out that only to pressurize applicant and his family members and with a view to give counter blast to the complaint application filed by applicant's father, applicant is falsely implicated in the present crime.

Applicant appears to be a respectable person in the village and he has deep roots in the society and he will not abscond if released on bail. Except statements of sons of informant, there is no other material to support the allegations of informant.

Considering the peculiar facts of the case, application is allowed. In the event of arrest of applicants in connection with Crime No.No. 926 of 2023 registered with Sangamner City Police Station, District Ahmednagar for offence punishable under sections 327, 354-B, 323, 504, 506 read with section 34

of the Indian Penal Code, applicant Pranav @ Michel Bapusaheb Shelke be released on bail on executing P.B. and S.B. of Rs.15,000/- with one surety in the like amount. Applicant shall not tamper the prosecution evidence. [ NITIN B. SURYAWANSHI ] JUDGE S.P. Rane
