When the present matter was taken up for hearing, Shri N.P.Patil Jamalpurkar, learned Counsel appearing for the applicant i.e. respondent in the Election Petition, submitted that the applicant is not inclined to pursue the recovery of costs as awarded by the Honourable Apex Court in view of the fact that the respondent has expired in the intervening period.

Learned Counsel further submits that towards the costs as directed by this Court in Election Petition No.6/1995, the present applicant has deposited a sum of Rs.10,000/- ( Rs. ten thousand) and the said amount is lying with this Court. Learned Counsel further submitted that in view of the order passed by the Honourable Apex Court, awarding costs throughout, to the applicant, the applicant is entitled to receive back the said amount. Learned Counsel, further graciously submitted, that the amount so lying with the Registry may be directed to be transferred to the Library of the High Court Advocates Association at Aurangabad. Order accordingly. Civil Application stands disposed of.
