This is an application under section 439(2) of Code of Criminal Procedure, for cancellation of anticipatory bail granted to respondents no. 2 to 6. The offence is registered at Crime No. 298/2020 on 18.11.2022 with Ambhora Police Station, for the offences punishable under section 326, 324, 143, 147, 148, 149, 504, 506 of IPC.

Heard the learned advocate for the applicant, learned advocate for respondent No. 2 to 6 and learned Additional Public Prosecutor for State.

The respondents no. 2 to 6 were granted anticipatory Bhagyawant Punde

{2} 923-ACAB-2-2021 bail by order dated 16.12.2020. This order is impugned in the present application filed by the applicant on 05.12.2021 i.e. after one year of passing of the order of grant of anticipatory bail. Today, the matter is argued for admission.

The learned advocate for the respondents submits that charge sheet is already filed in the present matter on 19.11.2021 and the case is numbered as R.C.C. No. 178/2021 and the same is pending in the Court of Judicial Magistrate Fist Class, Ashti. In that view of the matter and since two years have been lapsed since granting anticipatory bail, this Court is not inclined to entertain the application. The application is therefore, rejected.
