The petitioner / plaintiff is aggrieved by a cryptic order dated 6.11.2017, passed by the trial Court, rejecting application Exhibit 27, seeking appointment of a Court Commissioner in RCS No.340 of 2014. 2.
It is an admitted position that Exhibit 27 was filed before the recording of oral evidence was completed. It is equally admitted that Exhibit 27 was a second application of the kind, which has been rejected.

This Court has consistently held in the following judgments that the Court Commissioner should not be appointed before the oral evidence is completed, unless in rare and peculiar cases:- akl/d

In the light of the above, this petition is disposed off. Needless to state, after the recording of oral evidence is concluded in the suit, if any of the parties prefer an application for appointment of a Court Commissioner, the trial Court would consider the same on its own merits, without being influenced by any of it's earlier orders and after assessing whether it requires the assistance of a Court Commissioner.
