The learned AGP submits that the petitioner, by this petition, seeks compassionate appointment in Government service i.e. the Irrigation Department. In the light of Sections 3(q) and 15 of the Administrative Tribunals Act, 1985, the petitioner will have to approach the learned Maharashtra Administrative Tribunal. 2.

The learned Advocate for the petitioner submits that instead of converting this petition into an O.A., the petitioner would prefer an independent O.A. before the learned Tribunal. 3.
