This petition is pending since last more than 13 years. The grievance of the petitioners can be stated as under. 2.
The petitioner No. 1 is a Society registered under Societies Registration Act and it is a public trust. It used to run school for physically challenged students. It is stated in the petition that the strength of the students was more than 200. The petitioners stated that they have sanctioned posts of teaching and non-teaching staff which would be sufficient only to 140 students. The petitioners, therefore, wanted directions of this Court to the respondents to provide them more grant-in-aid and to allow them to recruit more staff members and grant sanction for their appointment.

The respondents, came with the case that the petitioner did not at any time had more than 140 students. The local Social welfare Officer who is respondent No. 5 has submitted his report which indicates that, on inspection, the strength of the students was never found to be more than 140. Admittedly, the petitioners are paid grant in aid which was sufficient to run the school of 140 students. During the pendency of this petition, the Government recognition of the School run by the petitioners is withdrawn in the year 2007. There is no school now, so, there is no question of allowing this petition and to direct the respondents to pay any amount of grant etc.

The writ petition stands dismissed.

In addition to this, it is made clear that if the petitioners are entitled to any amount from the respondents in respect of work done earlier, we are not denying them opportunity to seek such help. ( V. K. JADHAV, J.) ( A. V. NIRGUDE, J. ) ........
