The petitioner has been seeking migration from the reserved category to the open, in spite of having derived concession in the matter of reaching a benchmark to the extent of 5% of the marks at the TET for becoming eligible for appearing at the qualifying examination called TAIT. 2.

The learned advocate for the petitioner concedes that the fact situation of the petition stands squarely covered by the judgment and order of this Court in a group matters bearing WP No.8610/2024; Vijay Vishwanath Sanap Vs. The State of Maharashtra and connected writ petitions, decided on 14.02.2025. He submits that since the petitioner

2 946.WP.3529.25.odt was not party to any of those writ petitions and intends to approach the Supreme Court seeking a similar relief and since the order of this Court has been challenged before the Supreme Court, for the self same reasons the petition may be dismissed.

Learned AGP who appears for the respondents No.1 and 2 concurs with the submission being made by the learned advocate for the petitioner.

On concession, the petition is dismissed for the self same reasons as have been recorded in the WP No.8610/2024 by the judgment order dated 14.02.2025.
