When the matter is called out, none appears for the petitioner. When the petition was called out for hearing on 16.02.2010, none appeared for the petitioner. Therefore, the petition was dismissed for nonprosecution. The petitioner filed Civil Application for restoration of the said petition. This Court on 29.07.2011 allowed the said Civil Application subject to deposit of Rs.1000/- with the High Court Bar Association Library, Aurangabad within two weeks from passing said order. There is report of the Registry that till date the amount is not deposited. In the circumstances, since the amount is not deposited within stipulated time, it is needless to observe that the status of the petition remains as dismissed.

In that view of the matter, no further orders are necessary. The petition is treated to have been dismissed.

The Registry shall not allow registration of civil application for restoration of the petition, in view of the conduct of the petitioner in not depositing the costs from the year 2011.
