Heard both sides.

Upon perusal of the record, it is found that in view of the absence of the present petitioner/accused, the learned Judicial Magistrate First Class has issued non-bailable warrant against the petitioner. I do not find any illegality committed by the learned Judicial Magistrate First Class while passing the impugned order. There is no merit in the present writ petition. The same is, therefore, dismissed.

In view of dismissal of the writ petition, the interim relief granted by this court vide order dated 7th January, 2015 shall stand vacated. The amount

criwp15-2015 of Rs. 50,000/- (rupees fifty thousand) deposited by the present petitioner in view of the said order dated 7th January, 2015, be refunded to the petitioner. .

The petition accordingly stands disposed of.
