Heard Mr. Thombre, the learned counsel for the petitioner. Mr. Dambe, the learned counsel for respondent No.2. states that the petitioner has remedy before the Commissioner under Rule 14 of the Maharashtra Zilla Parishad and Panchayat Samiti Rules. In that light of that though Mr. Thombre, the learned counsel for the petitioner sought to canvass submissions on merits, we are not inclined to consider the same. 2.

Writ petition is disposed of with liberty to the petitioner to avail alternate remedy.

If the appeal is filed within fifteen days from today, the question of limitation would not arise. It is made clear that we have not considered the merits of the case. In case the appeal is filed by the petitioner, the Commissioner shall dispose of the same expeditiously preferably within six months from the date of receipt of appeal. No costs. All contentions are kept open.
