The petitioner challenges the order dated 03.05.2023, whereby the application filed by the applicant for legal heirship certificate is rejected on account of non prosecution. The petitioner has also placed on record, at page no. 62, an application filed by the wife of the deceased for the heirship certificate bearing no.122/2021, wherein the name of the present petitioner is also mentioned as one of the legal heirs.

Liberty to the petitioner to raise whatever contentions in the said application. The petitioner has also filed written statement in the said proceedings. In view of the same, there is no reason to restore the application for legal heirship filed by the petitioner. 4.

The writ petition is disposed of accordingly.
