Heard the learned counsel for the applicant, learned A.P.P for the respondent-State and learned counsel for respondent No.2 appointed through legal aid for the victim.

Perused the allegations. Considering the allegations and the progress in investigation the Court is of the view that if the applicant would be released on bail, no prejudice would cause to the prosecution. Nothing is to be investigated from the applicant. Hence the following order :-

ORDER

i) The application is allowed.

(ii) Applicant Musharaf @ Prince Akhlakh Pathan, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty

929- B.A. No. 48-2023.odt Thousand) with one solvent surety of the like amount, in Crime No.0500/2022, registered with Shivaji Nagar Police Station, District Latur for the ofences punishable under Sections 354(A),354(D), 384, 506 of the Indian Penal Code and Section 8 and 12 POCSO Act on the condition that :

(a) The applicant shall not contact the victim in any way till conclusion of the trial.

(b) The Secretary, High Court Legal Services Sub-Committee, Aurangabad do pay the legal fee to the learned counsel appointed for the respondent No.2/victim as per the schedule.
