Mr. Godhamgaonkar, the learned counsel for petitioners states that, the petitioners No.2 and 3 are dead during the pendency of the present petition. Petitioner No.1 at the relevant time was the Councilor and is made a party and has joined petitioners No.2 and 3 in prosecuting the present petition.

The legal representatives of petitioners No.2 and 3 are not brought on record. The petitioner No.1 does not have any personal interest in the petition. The rights of petitioners No.2 and 3 being affected, are dead.
