The learned Counsel for the petitioner submits that the petitioner is entitled for appointment on compassionate ground, however, the respondents are neither absorbing him nor appointing on the post of Lab Assistant or any other suitable non-teaching post as per the educational qualification of the petitioner.

Mr.P.R.Patil, learned Counsel for respondent nos.1 and 2 - Institution submits that the petitioner's case has been considered and he is already placed on the wait list at Serial No.19 and he will be considered for appointment on compassionate ground as per the turn in wait list. 4.

As the name of the petitioner is already included in the wait list of the persons to be appointed on compassionate ground and it is not the grievance of the petitioner that the respondents have breached the queue, the respondents may consider the case of the petitioner as per the turn in wait list.

In view of the above, the Writ Petition is disposed of.
