It is claimed by the applicant that on 14/10/2013 this Court granted regular bail in Criminal Application No. 5026 of 2013 by incorporating condition that till disposal of trial, he shall not enter village of the prosecutrix.

It is now claimed that the prosecutrix is married and stayed in Gujarat, in this background, relaxation is sought.

In my opinion, relaxation can be granted as the prosecutrix is not staying in the village because of her marriage and the crime is almost three years old. As such, the application is allowed.

The applicant to enter the village of prosecutrix, however, shall not tamper with the evidence.
