On last occasion, learned counsel for the appellant showed communication and envelope bearing remark as 'refused'. Today also he informs that his client does not have any interest and she is not responding.

Learned counsel Mr.Patil appearing for the respondent submits that both the courts below are against the appellant and subject matter was purchased by the municipal council and possession was also taken from the appellant. She must be paid almost entire consideration. Apparently, there is reason to infer that the appellant is not interested in prosecuting the matter.

Second appeal is dismissed for default.
