1) Heard both the sides. Learned counsel for the respondent Shri. S.G. Chapalgaonkar produced copy of decision given in Second Appeal No.568/2014 by this Court. It appears that the previous suit is finally decided and in view of this circumstance, there is no question of consideration of provision of section 10 of Civil Procedure Code in respect of the subsequently instituted suit. So, the present matter has become infructuous. The petition is disposed of as infructuous.
