Heard the learned Counsel for the applicants and respondents. The applicants are permitted to withdraw 50% of the deposited amount on furnishing an undertaking to the satisfaction of the Registrar of this Court. Balance 50% amount be invested in FDR in any Nationalize Bank initially for the period of two years and if so required for the further period till disposal of the appeal. Civil application for withdrawal of amount shall stand disposed of. 2.
Delay of 1084 days has occurred in filing the present appeal by the Insurance Company. The reasons in justification of the delay caused are stated in para 3 and 4 of the application. Though the learned counsel appearing for the respondent i.e. original claimants has opposed for condoning the delay, for the reasons stated in the application which according to me are just and sufficient, the delay is condoned. Appeal be registered in accordance with the law. Civil application for condonation of delay stands disposed of.

On registration of the Appeal, issue notice to the
915 ca 1896-17+.odt respondents. The learned counsel Mr. S. B. Kadu appears for respondent no.1 to 5. The learned Counsel Mr. Mujtaba Gulam Mustafa appeared for respondent no.7.
