ORDER :- 1.

This civil application is filed to bring on record LRs of respondent No.4.

There is delay in filing the civil application. The proposed LRs of respondent No.4 are being served and Advocate Mr. Sandeep Swami appears for proposed LRs of respondent 4C to 4E. He has no objection if this civil application is allowed. 3.

The Division Bench of this Court in Keshao Kawadu Maral and another Versus State of Maharashtra, reported in 2005 (supp.) B.C.R. 226, condoned the delay of six years in filing the application for bringing legal heirs on record relying upon judgment of Hon'ble Supreme Court in the case of Sardar Amarjit Singh Kalra (Died) by LRs and others Versus Pramod Gupta (Smt.) Dead) by Lrs. And others, reported in (2003) 3 SCC 272.

In view of the ratio laid down in the aforesaid case and the fact that Advocate Mr. Swami has no objection for allowing the civil application, the present civil application is allowed in terms of prayer

Amendment be carried out within 4 weeks from today. 6.
