Heard the learned counsel for the applicant and the learned A.P.P. for the respondent-State.

The applicant is husband of the deceased. The deceased committed suicide in the house of the applicant. The first information report reveals that the marital life of the applicant and the deceased was not happy. The allegations have been levelled that the applicant was raising suspicion over the character of the deceased. They had quarrel over the allegations. She stayed three months with her parents then again came to cohabitation. There appears contradiction as regards the payment of Rs. 10,000/-. At one point of time it has been alleged that it was paid for the household expenses and on the other hand it was paid to the accused to run the business. Record also reveals that post hanging

923- B. A. No. 54-2023.odt the deceased, the applicant called neibourers for help. Considering the facts and allegations levelled against the applicant, applicant has a good case for bail. Hence, the following order :-

ORDER

(i) The application is allowed.

(ii) The applicant Bharat S/o Babasaheb Kasar, be released on bail, on executing P.B. and S.B. of Rs. 50,000/-, with one solvent surety in the like amount, in C.R. No. 508 of 2022 registered with Taluka Jalna Police Station, Dist. Jalna for the offences punishable under Sections 304(B), 323, 498 (A), 504, 506 read with Section 34 of the Indian Penal Code on the condition that the applicant shall not tamper with the prosecution witnesses.
