The learned counsel for the petitioner submits that, during the pendency of this writ petition, the petitioner/original plaintiff has filed an application in terms of the provisions of Section 65-B of the Indian Evidence Act. 2.

In view of the same, this writ petition can be disposed of by directing the trial court to decide the said application without getting prejudiced by the orders passed below exh.114 and 115. The trial court is directed accordingly and writ petition is disposed of. No costs.
