By the present application under section 438 of the Code of Criminal Procedure, the applicant is seeking his release on pre-arrest bail, in connection with C.R. No.162 of 2015, registered with police station, Ashti, Dist. Beed, for offences punishable under sections 420, 464, 471 read with section 34 of the Indian Penal Code and under section 66 (C) & (D) of the I.T. Act.

Perusal of the first information report and other investigation papers depicts in detail the mode and manner in which the applicant has played fraud on the examination system, so as to achieve his object of securing employment, particularly ignoring the rightful claim of deserving persons.

In my opinion, custodial interrogation of the applicant is necessary. There is prima facie material on record in respect of involvement of the applicant in the crime in question.

In view thereof, in my opinion, no case is made out for grant of prearrest bail to the applicant. Thus, the application fails and stands rejected. (N.W. SAMBRE, J.) amj
