PER COURT :- 1.

The applicant is convicted by the Trial Court for the offence punishable under section 354 of the Indian Penal Code and sentenced him to suffer S.I. For three months and to pay a fine of Rs.3,000/-, in default to suffer S.I. For three months. Said judgment and order of conviction is also confirmed by the Additional Sessions Judge, Bhusawal in Criminal Appeal No.151/2014. The applicant has, therefore, preferred Criminal Revision Application No.10/2016 before this Court and the same is admitted by this Court.

Learned counsel submits that the applicant was on bail during the trial and also during the pendency of Criminal Appeal before the Sessions Court. Learned counsel further submits that the applicant has already deposited the fine amount before the Trial Court.

In view of this, following order is passed.

O R D E R

1.

Application is hereby allowed.

2.

The substantive part of the sentence passed by the Judicial Magistrate First Class, Yawal in SCC No.67/2011 dated 21.01.2013 and confirmed by the Additional Sessions Judge, Bhusawal in Criminal Appeal No.151/2014 is hereby suspended till the disposal of the Criminal Revision Application No.10/2016, and the applicant Anil Bhivsan Salunke be released on bail on his furnishing P.B.of Rs.10,000/- (Rs Ten Thousand), with one surety of the like amount.

Hamdast allowed.

Application is disposed of.
