The petitioner is awaiting decision of the scrutiny committee on a proposal for validation of his 'Malhar Koli' scheduled tribe certificate. However, in the meantime by the impugned communication dated 18.12.2024 he has been sought to be placed in the supernumerary post presumably in the light of the Government Resolution dated 21.12.2019.

Obviously, it is resorting to the subsequent Government Resolution dated 14.12.2022 that elaborate instructions have been given in respect of the employees who will have to be placed in supernumerary category, which conspicuously does not provide for category of the employees whose claims for validation are pending with the scrutiny 1/2

We dispose of the writ petition directing respondent - Scrutiny Committee to decide the petitioner's proposal, as expeditiously as possible and in any case within twelve weeks.
